TRADEMARKS AND BRANDS

Western Electric's Philosophy on Trademarks and Brands

Western Electric trademarks and brands are Western Electric intellectual property and are important and valuable assets of the corporation. Trademarks must be used properly. Follow these Guidelines for using Western Electric® trademarks and brands properly in communications, documents and electronic messages.

Who Do These Guidelines Apply To?

These Guidelines apply to Western Electric employees, customers, licensees, consultants, outside vendors, and other third parties.

If you are a LICENSEE of a Western Electric trademark or logo, your license agreement that you signed with Western Electric may have special trademark and logo usage guidelines different than the Guidelines set forth here. If so, please follow the special guidelines provided to you pursuant to your license agreement. If you are a Licensee, but have been provided no special guidelines, then follow these.

Using Western Electric's Trademarks and Logos

You may refer to Western Electric products and services by their associated Western Electric trademarks and service marks, so long as such references (a) are truthful, fair, and not misleading, and (b) comply with these Guidelines, which may be modified by Western Electric from time to time in Western Electric's sole discretion.

Specifically:

  • Use the appropriate trademark symbol and trademark acknowledgment (below) of Western Electric's ownership of the marks and/or logos in question.

  • Do not incorporate Western Electric trademarks or logos into your own product names, service names, trademarks, logos, or company names, and do not adopt marks or logos that are confusingly similar to Western Electric's marks and logos.

  • Do not make unlicensed use of Western Electric's licensed logos, such as Western Electric®, WE SELECT®, WE (Stylized), Western Electric®. Third-party use of Western Electric logos requires a license or written permission from Western Electric. If you are interested in obtaining a license to use a Western Electric mark or logo, send email to trademarks@westernelectric.com.

Trademark Symbols & Acknowledgements

Trademark Symbols

  • In letters, memos, press releases, white papers, advertising, slides, foils, video, and other multimedia presentations:

  • Properly designate (with ®, ™ or SM) all of Western Electric's trademarks at the most prominent use (usually a headline) and again on the first occurrence in copy.

  • In the case of presentation graphics, trademarks should be designated with the proper trademark symbol on each page, slide, and foil.

  • In newsletters, magazines, and publications containing multiple articles:

  • Properly designate (with ®, ™ or SM) all of Western Electric's trademarks on the first occurrence in the Table of Contents, in headlines and on the first occurrence in EVERY article in which they are used.

  • In brochures, annual/quarterly reports, books, technical documentation, and other bound documents:

  • Properly designate (with ®, ™ or SM) all of Western Electric's trademarks on the first occurrence in the Table of Contents, in headlines, and on the first occurrence in text.

  • In all charts or graphs, properly designate trademarks (with ®, ™ or SM), as they could be copied or pulled and used independently.

  • In all tag lines incorporating a trademark slogan, always use the trademark symbol in every reference.

Trademark Acknowledgments

Properly footnote and acknowledge trademark ownership, preferably identifying Western Electric Corporation marks as being owned by Western Electric, e.g., [Mark] is a trademark of Western Electric or its subsidiaries in the U.S. and/or other countries.

The appropriate acknowledgment line for all our brands is, "Western Electric®, WE SELECT®, Amperex, GenRad, Air Motion Transformer, AMT, Barton and Gray, Fairchild and WHEN YOU”RE THROUGH COMPROMISING®, WESTREX, WE (Stylized), Western Electric (Stylized), rAMT, BVA, GEC, Radiotron, THE MOST TRUSTED NAME IN ELECTRONICS are trademarks of Western Electric or its subsidiaries in the U.S. and/or other countries."

Note: Trademarks and logos licensed by Western Electric to you may have specific contractual acknowledgment requirements or other restrictions. Refer to your contract or license for specific requirements

Third-Party Use of Western Electric Code Names

Western Electric uses internal code names to identify products (and services) that are in development and not yet released to the public. Once a Western Electric product is announced to the public, it will receive and be promoted under a commercial name (e.g., AMT#001).

After Western Electric announces a product or service under its commercial name, all reference to that product or service by the Western Electric code name should cease entirely, and instead should be made with the commercial name only. Use of the correct Western Electric commercial product names in advertising and marketing materials is essential to accurate and effective marketing communications, and to avoid potential legal claims based on the use of a Western Electric code name.

Third Party Use of Western Electric Code Names

Customers, licensees, and other third parties are not authorized by Western Electric to use Western Electric code names in advertising, promotion or marketing of any product or service. The use of any Western Electric code name in advertising will automatically disqualify the advertisement from qualification for reimbursement under any Western Electric cooperative marketing program, and could result in termination from Western Electric marketing programs.

Third Party Reference to a Western Electric Code Name (at users sole risk)

Notwithstanding the above, Western Electric will not object to a limited reference to the Western Electric code name by customers and licensees at trade shows or in press releases, channel presentations, technical papers and marketing collateral, that are distributed to a defined ("targeted") audience – not the general public. In addition, Western Electric® does not object to customer/licensee use of "unique technology names" in marketing materials in lieu of the code name (or in advertising) if accurate and not misleading. However, any such use of the code name is at the user's sole risk (see below).

No Liability, Warranty or Indemnification for Use of Western Electric Code Names

Western Electric does not represent or warrant that any Western Electric code name is non-infringing or available for use in commerce. Use by customers, licensees, or other third parties of Western Electric code names may provoke legal challenges from others claiming rights in such names, and may result in legal liability. Western Electric accepts no responsibility or liability arising from or related to such third party use (in any way) of Western Electric code names. Western Electric will not under any circumstances indemnify, defend or hold harmless any customer, licensee, or other third party for the use of a Western Electric code name. Third party use of Western Electric code names is at the user's sole risk.

Should you have any questions regarding the use of a Western Electric code name, please send email to trademark@westernelectric.com.
